Key LGPD Terms Explained:

We know legal terms can be complex. Given this law’s importance, we’ve prepared this glossary to help you understand key LGPD (Brazilian General Data Protection Law) concepts:

ANPD – National Data Protection Authority, the regulatory body established by the LGPD to oversee compliance and enforce penalties for violations.

Legal Bases – Lawful grounds justifying personal data processing for specific purposes.

CONSENT – The unambiguous authorization given by the data subject for the processing of their personal data for a pre-defined purpose, where the legal basis for such processing requires the data subject’s explicit approval. For the processing of sensitive data, consent must additionally be specific and informed.

DATA CONTROLLER – The entity that carries out stages of data processing and has decision-making power over the personal information in its possession.

PERSONAL DATA – is any information related to an identified or identifiable natural person. ID cards, CPF, address, date of birth are some examples of personal data, but information such as consumption habits, geographic location, behavioral profile, preferences, purchase history and other similar information, when related to an identified or identifiable natural person, are considered “personal data”. Likewise, information about Internet browsing, such as IP address and cookies, among others, are generally considered personal data whenever it is possible to identify the person related to these identifiers.

SENSITIVE PERSONAL DATA – personal data that carries potential risks of harm, exposure, or discrimination to the data subject, and which receives specific protection under data protection laws.

DPO – abbreviation of the English term Data Protection Officer – which translates to the role of Encarregado de Proteção de Dados (Data Protection Officer);

DPO AS A SERVICE – English term meaning the provision of services by an external company or individual outside the organization’s structure that processes personal data;

DATA PROTECTION OFFICER – the professional equivalent to the DPO – as established in the GDPR, the European data protection law, whose role is to manage the company’s privacy program, with responsibilities defined by the Data Protection Law.

EVIDENCE – any element that can prove or indicate proof of a particular fact;
